How do you proceed with the purchase?
If you have found the property that is right for you, all you have to do is sign an irrevocable purchase proposal, which, if accepted by the seller, assumes a joint and several commitment of a real contract concluded as a real preliminary sale, subject as such to all the requirements relating to the latter: written form, content, anti-money laundering obligations of brokers and professionals, any guarantor obligations, compulsory registration, etc..
What is the Preliminary Sale?
The Preliminary Sale Agreement is the main contractual instrument by which anyone who intends to buy or sell a house (or any other property) undertakes, in writing under penalty of nullity (the void contract is invalid and has no effect), to do so. Mind you, the parties undertake or, to put it more precisely, legally binding on each other to sell and purchase the property. This means that the parties to the contract, and more precisely the seller/provider, the owner of the property who intends to sell it, and the buyer/provider, who therefore intends to purchase, undertake the commitment or obligation, respectively, to sell and purchase the house, and therefore undertake to enter into a new contract, the definitive contract of sale, with which only the transfer of ownership will take place.
Quanto si versa al Preliminare di Vendita?
Si può dire che un buon contratto preliminare è l’atto essenziale perché si arrivi nel migliore dei modi e senza sorprese alla vendita per Atto Pubblico. Contestualmente alla sottoscrizione di un contratto preliminare, la parte acquirente versa alla parte venditrice, a titolo di caparra confirmatoria un importo che può variare dal 10% al 30%. La variabilità di questo importo è direttamente dipendente dal prezzo dell’immobile e dal tempo intercorrente tra la data stipula del contratto preliminare e la data di stipula dell’Atto Pubblico di trasferimento della proprietà
What's A.P.E.?
It is the mandatory document required by law for the sale and advertising of a property and can only be drawn up by qualified technicians in the Region. It represents the energy label of the property that in consideration of multiple parameters, not only structural, expresses the energy consumption of your home. It is expressed through a numerical index in Kw/sq.m. and a letter from A to G where G indicates the lowest class with the highest consumption and A the highest with the lowest energy consumption. The EPA has a duration of 10 years.
Who has to pay the commissions and how much are they?
According to art. 1754 of the Italian Civil Code, a mediator is someone who brings two or more parties together to conclude a deal, without being tied to any of them by a relationship of collaboration, dependence or representation. Article 1755 indicates that the mediator is entitled to commission from each of the parties (2950), if the deal is concluded as a result of his intervention.
The percentage of the commission to be paid to the agency is a percentage of the selling price and is 3%+VAT borne by the seller and 3%+VAT borne by the buyer..

In fact, it should not be forgotten that the mediator according to the law (art.1754 Civil Code), is the one who puts in contact two or more parties for the conclusion of a contract, without being tied to any of them by relationships of collaboration, dependence or representation. This means that the mediator must be impartial and must pursue the interests of both parties, communicating all the circumstances known to him relating to the evaluation and security of the business, even if of such content as to lead one of the parties not to conclude the contract or to sign it under different conditions.
